Terms and conditions

  1. General provisions

1.1 These Terms of Sale (hereinafter referred to as the Terms) set out the mutual rights, obligations and responsibilities of the Buyer and Finola Group LTD (hereinafter referred to as the Seller) when the Buyer purchases goods in the e-shop.

1.2 The photos of the goods are for illustrative purposes only, the original products may differ from the ones shown. The photos provided cannot be used as a basis for claims. A product is considered to be of good quality if it conforms to the sample, model or description provided in the online store.

 

  1. The moment of concluding the purchase and sale agreement

2.1. The purchase and sale agreement between the Buyer and the Seller is considered concluded from the moment when the Buyer has formed a shopping cart in the e-shop, provided the delivery address, selected the payment method and read these terms, clicks the “Confirm order” button and is valid until fully performed.

2.2. Each contract concluded between the Buyer and the Seller is protected by Finola Group LTD.

 

  1. Buyer’s rights

3.1. The Buyer has the right to purchase goods in the e-shop.

3.2. The Buyer (consumer) has the right to withdraw from the contract of purchase and sale of goods with the Seller by notifying the Seller in writing within 14 working days from the date of delivery of the goods, 

 

  1. Obligations of the Buyer

4.1. The buyer must accept the ordered goods and pay the price of the goods and their delivery.

4.2. If the data provided in the Buyer’s registration form changes, the Buyer must update them immediately.

4.3. The goods selected by the Buyer are reserved and the Seller undertakes to execute the purchase and sale agreement only when the Seller receives a notification from the Buyer’s bank about payment for the selected goods. The buyer must confirm the payment order no later than 24 hours after clicking the “Confirm order” button. If the payment order is not confirmed within this term, the Seller has the right to consider that the Buyer has withdrawn from the sales contract.

 

  1. Seller’s Rights

5.1. If the Buyer tries to impair the operation or stable operation of the e-shop, the Seller may, without prior notice, restrict, suspend (terminate) his access to the e-shop.

5.2. The seller has the right to temporarily or indefinitely terminate the operation of the e-shop without separate notice.

 

  1. Responsibilities of the Seller

6.1. To create conditions for the Buyer to properly use the services provided by the e-shop.

6.2. To organize the delivery of the goods ordered by the Buyer to the address specified by the Buyer.

6.3. The Seller, in case of significant circumstances, unable to deliver the ordered goods to the Buyer, undertakes to offer the Buyer an analogous product, and if the Buyer refuses to accept the analogue of the goods, return the money paid by the Buyer within 5 working days. In this case, the Seller is released from liability for non-delivery of the goods.

 

  1. Delivery of goods

7.1. The goods are delivered at the expense of the Buyer by the transport company.

7.2. The goods are delivered to the address specified by the Buyer within 2-6 working days from the received payment for the goods and transportation of the goods. 

7.3. The exact delivery price depends on the weight, volume, dimensions and place of delivery of the ordered goods, so you will see the final price only when you have placed the order.

7.4. During the delivery of the goods, the Buyer together with the representative of the transport company must check the condition of the shipment, the quantity, quality and range of the goods.

7.5. If the Buyer notices the violation of the consignment, the quantity, quality and assortment of the goods, the Buyer must not accept the consignment and note this in the consignment note. After the buyer accepts the consignment and signs the consignment note without comments, it is considered that the delivered consignment is free of defects, the quantity, quality and range of goods comply with the terms of the sales contract.

 

  1. Return of goods

8.1. If the Buyer (consumer) withdraws from the contract of purchase and sale of goods, as provided for in Clause 3.2 of the Conditions, the goods shall be returned to the Seller’s account within 7 days from the Buyer’s written notice of withdrawal from the contract of purchase and sale. Items that the buyer (consumer) does not like – the shape, size, color, model or completeness (are replaced or accepted from the Buyer within 14 days of delivery to the nearest Finola Group LTD branch.
